The Colombo Chief Magistrate Mohommed Mihail yesterday refused to remand Hiroz Eliyaaz, captain of the distressed oil tanker MT New Diamond and issued a overseas travel ban on him. The Captain had been issued notices to appear before the court and according to the captain arrived at the court yesterday morning.
The Magistrate also issued an order directing the captain to assist in the ongoing investigations conducted by the Criminal Investigation Department.
When the matter was taken up before the court yesterday morning, Deputy Solicitor General Dileepa Peiris appearing on behalf of the Attorney General’s Department informed the court that indictments will be filed with the Colombo High Court against the captain of ‘MT New Diamond’ vessel. Deputy Solicitor General Dileepa Peiris requested that the captain be remanded as there was a tendency for the captain to evade court before such a case was filed.
While raising objections , the Attorney-at-Law appearing on behalf of the captain stated that the Magistrate court has no jurisdiction to issue notices on his client.

The Greek captain of the crude oil tanker ‘MT New Diamond’ vessel has arrived before the Colombo Chief Magistrate’s Court.
Colombo Additional Magistrate Priyantha Liyanage on Thursday issued summons on the Captain of ‘MT New Diamond’ to appear before court today. The Magistrate made this order pursuant to a request made by Deputy Solicitor General Dileepa Peiris.
