Former Galle Magistrate gets ten years’ RI, tried in absentia

Charged for altering excise duty fines, arrest warrant issued

An open warrant was yesterday issued against the former Galle Magistrate D. S. Mirinchiarachchi who was convicted of four charges under the Public Property Act and sentenced to ten years rigorous imprisonment, to arrest and produce before court by the Colombo High Court.

The order was delivered by Colombo High Court Judge Amal Ranaraja.

According to the provisions of the Criminal Procedure Code, the case was tried in the absence of the accused and the open warrant was issued based on the information produced by the State Counsel that the accused was abroad according to the reports of the Criminal Investigation Department.

The Attorney General filed indictment in the Colombo High Court in 2019 against the former Galle Magistrate alleging that an offence has been committed under the Public Property Act by altering the fines charged for excise duty offences, of Rs.7,500 to Rs.1,500 and the fine of Rs.5,000 to Rs.2,500 imposed against suspects in two cases heard in the Galle Magistrate’s court.

The accused has absconded from court since the inception of the trial and the Colombo High Court held the trial of these cases in the absence of the accused under Section 241 of the Criminal Procedure Code, and sentenced her to five years imprisonment and imposed a fine of Rs.22,500.
