The case filed against the three accused including former State Minister Nalaka Godahewa for criminally misusing Government funds of Rs. 5 million belonging to the Sri Lanka Exchange and Securities to the Tharunyata Hetak organization was fixed for judgement on January 26, 2023 by the Colombo High Court.
The case was taken up before Colombo High Court Judge Amal Ranaraja.
The third prosecution witness was to testify before the Court yesterday. However, as the witness is in a state of poor health, the prosecution requested that the witness be released from the case and the prosecution informed the Court that they are concluding the hearing as the prosecution.
Following that, President’s Counsel Shavendra Fernando sought from the Court to release the accused from the case without summoning dock statements if the prosecution concludes the case. According to the evidence summoned by the prosecution so far, the prosecution has not been able to prove the allegations against the accused beyond reasonable doubt, so the accused were also requested to be released from the case.
After considering the facts, the Colombo High Court Judge ordered the defense to file written submissions regarding the matter before the Court.
