The Colombo District Court yesterday ordered to dismiss the request made by Ports, Shipping and Aviation Minister Nimal Siripala de Silva seeking an interim injunction against the decision to remove him from the positions of the Sri Lanka Freedom Party (SLFP).
After considering the facts presented by both parties, the order was delivered by the Colombo District Court Judge Purnima Paranagama.
The case was filed by Ports, Shipping and Aviation Minister Nimal Siripala de Silva against former President Maithripala Sirisena and MP Dayasiri Jayasekara.
The case was filed through Attorney-at-Law Sanath Wijewardena and President’s Counsel Romesh de Silva appeared for the prosecution.
President’s Counsel Chandaka Jayasundara appearing for the defence, informed the court yesterday that the defendants have acted according to the constitution of the Sri Lanka Freedom Party of Sri Lanka.
This case was filed by seeking a declaration that he still holds the positions of Senior Vice President, Central Committee Member, Political Committee Member, Badulla District Leader and Organizer, and Halilela Acting Organizer of the Sri Lanka Freedom Party. Minister Nimal Siripala de Silva produced facts before the court that the Sri Lanka Freedom Party, which organized a meeting called the All Island Committee, had made an amendment to the party’s constitution on September 2 and the respondents claimed that they had removed his positions according to the powers given to the second respondent by that Constitutional amendment.
Minister Nimal Siripala de Silva claims that he also received an invitation to the All Island Committee meeting and has informed the court that such a committee does not have the legal authority to amend the party constitution.
Accordingly, he seeks a declaration from the court that he is still holding positions in the party and to prohibit any obstruction from the respondents or their representatives while holding positions.
The prosecution was ordered to produce their submissions on March 07, 2023 by the Colombo District Court.
