The Supreme Court yesterday (25) dismissed a case filed by Sudantha Senanayake, a former Basnayake Nilame, against Diyawadana Nilame of Sri Dalada Maligawa Pradeep Nilanga Dela, for not properly submitting the income and expenditure accounts of the Sri Dalada Maligawa.
The verdict was announced by High Court Judge R.S.S.Sapuwida at Kandy High Court No.01 and the petitioner was ordered to pay Rs.100,000 to the Diyawadana Nilame as costs.
Accordingly, Sudantha Senanayake handed over the relevant amount to the Diyawadana Nilame in court.
In 2012, Senanayake filed a case at the Kandy Magistrate’s Court alleging that the Sri Dalada Maligawa income and expenditure accounts had not been submitted properly.
When the case was about to be heard, the High Court Judges dismissed the case according to a statement made by the Diyawadana Nilame by submitting a revision application against it and explaining facts.
As Senanayake had filed a suit claiming that the Diyawadana Nilame had not submitted the accounting reports in relation to four quarters, properly, the High Court Judge ordered the petitioner to pay Rs.125,000 in respect of each case filed, a total of Rs.500,000 as case costs. Senanayake had filed an appeal against this order at the Court of Appeal, and the decision given by the High Court was confirmed by them as well. Then Sudantha Senanayake went to the Supreme Court against this verdict, and there they had changed the decision of the Court of Appeal and decided that Rs.25,000 per case be paid to Nilanga Dela.
The decision was announced yesterday (25) by Kandy High Court Judge R.S.S.Sapuwida.
Saman Thanthirige appeared on behalf of the Diyawadana Nilame of the Sri Dalada Maligawa, Nilanga Dela while Matheesha Senevirate appeared for Sudantha Senanayake.
