The Colombo Commercial High Court yesterday issued an Interim Order preventing the remake of the song titled ‘Me bajar ekata malli’ from the movie “Address Ne” directed by veteran actor Jackson Anthony and its release in advertisements and social media.
This order has been issued to the defendants Saregama Films, Saregama Music Private Company, Singer Santhush Weeraman and Ceylon Cold Stores.
The order was issued by Colombo Commercial High Court Judge K.P. Fernando after considering a case filed by veteran musician, composer and singer Dr. Rohana Weerasinghe.
President’s Counsel Chandaka Jayasundara appearing for plaintiff Dr. Rohana Weerasinghe presented facts to the court that the song was written by Professor Sunil Ariyaratne and music composed by the plaintiff Rohana Weerasinghe and sung by Gayan Perera in the movie “Address Ne” directed by Jackson Anthony and the song was uploaded to the YouTube channel in violation of economic rights and intellectual property.
Accordingly, plaintiff Dr.Weerasinghe had presented facts in his complaint seeking an order ruling that his intellectual property rights are being violated and issuing orders to prevent the action.
After considering the facts, the Colombo Commercial High Court has issued interim order preventing the relevant song from being reproduced in any way, directly or indirectly using it continuously for advertisement campaigns and making copies.
On the advice of Attorney Lakshika Ratnayake, a panel of lawyers including President’s Counsel Chandaka Jayasundara appeared for the plaintiff.
